Martial Law Orders: Transfer of executive and judiciary power to the Commanders
Under the National Defence and Security Council’s Order No.1/2025, the council has declared the State of Emergency in certain townships for ending armed insurgency, and ensuring regional stability and rule of law.
According to Section 413(b) of the constitution, the council transferred the executive and judiciary power to the Commanders of the respective Commands to exercise Martial Law under Martial Law No.1.2025. Depending on the changing situation in the region, the commanders shall exercise Martial Law by himself or shall transfer the power to the regional military commanders.
The order was signed by Senior General Min Aung Hlaing, Commander-in-Chief of Defence Services. Likewise, under Martial Law Order 2/2025, local administrative bodies at different levels under the Martial Law area shall carry out the tasks concerned with them under the command of the Commander of respective Commands.
The Commanders shall designate the military regions in the martial law area and shall appoint the commanders of military regions by issuing Martial Law orders with the approval of the Commander-in-Chief of Defence Services. The Commanders of respective Commands shall accomplish the administrative and judiciary tasks by themselves, or military region commanders or an appropriate person or a body to which he transferred the power.
The Commanders of respective Commands shall form an advisory body for Martial Law to get assistance for performing their duties. The Commanders of respective Commands shall report to the Commander-in-Chief of Defence Services on the situation of the martial law area.
